北卡州议会正审议《农地与军事保护法案》（S.B. 394），旨在禁止“特定国家”（如中国、伊朗、朝鲜、俄罗斯）相关方购买本州农业用地及军事基地附近土地，以维护农业与国家安全。

法案要点：
    1.    限制对象：
来自上述国家的个人、政府、公司、代理人或控制33%以上股份的组织。
    2.    限制范围：
    •    农业用地；
    •    距军事基地25英里内土地（如布拉格堡、勒琼营等）
不含学校、住宅、教堂等。
    3.    豁免情形：
    •    居住在美的外国居民；
    •    小额股权投资（如持美股<10%）；
    •    经CFIUS审核或签署国家安全协议的企业。
    4.    已有土地处理：
    •    可继续持有，但须登记备案；
    •    未备案者每天罚款不少于$1,000；
    •    违法持有者须3年内出售或转让。
    5.    购地声明义务：
买方须提交声明，证明非“敌对方”；
附在土地过户文件中，无需公证。

Dear Community Members,

The North Carolina General Assembly is reviewing the Farmland and Military Protection Act (Senate Bill 394), which aims to prohibit entities from “Certain nations” (such as China, Iran, North Korea, and Russia) from purchasing farmland and land near military bases in order to safeguard agricultural and national security.

Key Points of the Bill:
    1.    Who Is Restricted:
Individuals, governments, companies, agents, or entities with 33% or more control from the above countries.
    2.    Land Restrictions:
    •    Farmland;
    •    Land within 25 miles of military bases (e.g., Fort Liberty, Camp Lejeune, etc.)
Excludes schools, residences, and churches.
    3.    Exemptions:
    •    Foreign residents living in the U.S.;
    •    Minor equity investments (e.g., holding less than 10% in U.S. public companies);
    •    Entities approved by CFIUS or under a national security agreement.
    4.    Handling of Existing Land Ownership:
    •    Ownership before the law takes effect may continue;
    •    Must register with the NC Secretary of State and Attorney General;
    •    Failure to register may result in fines of at least $1,000 per day;
    •    Unlawfully acquired land must be sold or transferred within 3 years.
    5.    Buyer Disclosure Requirement: Buyers must submit an affidavit affirming they are not a “prohibited party”;
This must be included in the deed transfer—no notarization required.

Conclusion:
Senate Bill 394 aims to restrict land purchases in North Carolina by entities from certain countries to enhance national security and land ownership transparency.
