关于中马互免签证协定停留期问题（大使馆发言人应答 中英文）

问：近日中马两国政府签署了互免签证协定受到两国各界热议，请问大使馆对此有何评论？

答：上个月，习近平主席对马来西亚进行国事访问，有力推动中马命运共同体建设朝着高水平战略性方向前进，必将开启两国关系下一个更加辉煌的“黄金50年”。访问期间，两国领导人见证交换了《中华人民共和国政府和马来西亚政府关于互免持公务普通护照和普通护照人员签证的协定》。协定将在两国政府履行必要程序后生效。该互免签证协定有效期5年，此后自动延期5年。

根据协定有关规定，中马目前互予对方国家公民的免签入境安排维持不变，即双方公民可免签入境对方国家单次停留不超过30天。

同时，根据国际惯例，协定明确了对缔约一方公民在缔约另一方境内免签停留的期限，即每180日累计停留不超过90日。对免签赴华的外国公民来说，指从任意自然日向前溯及的180日内，在华停留不超过90日（该90日不包含持用签证、APEC商务旅行卡以及居留证在华停居留的时间）。如入境时溯及的180日内免签停留时间累计已满90日，则无法再享用免签入境政策；累计不满90日，但剩余停留时间不足30日的，本次免签停留不得超过剩余的免签停留时间。中国人免签来马亦按此操作。

我们相信，随着协定下步生效实施，将进一步扩大两国之间的人文交流，加深两国人民的相互了解，促进各领域交流合作走深走实，推动中马构建高水平战略性命运共同体建设迈上新台阶。中国驻马来西亚大使馆将继续为两国人民的友好交往保驾护航。

On the Stay Duration for visa-free visits stipulated in the China-Malaysia Mutual Visa Exemption Agreement

Question:

The recently signed “China-Malaysia Mutual Visa Exemption Agreement” has become a hot topic in both countries. How does the embassy comment on this?

Answer:

Last month, President Xi Jinping paid a state visit to Malaysia, which added strong impetus to building the China-Malaysia Community with a Shared Future and advance it to the new height of high-level strategic development. It will undoubtedly usher China-Malaysia relations into another “Golden 50 Years”. The Mutual Visa Exemption Agreement was exchanged at the witness of both leaders during this visit. It will take into effect soon after domestic procedures are completed by both countries. The agreement shall be in force for a period of 5 years. Thereafter, it shall be automatically extended for a further period of 5 years.

According to this agreement, treatments provided to nationals of one country making visa-free visits to the other remain unchanged, which means, nationals of one country can enter into and stay on the territory of the other for up to 30 days per entry.

In addition, in line with relevant international norms, the agreement explicitly stipulates the maximum cumulative visa-free stay for nationals of one contracting party in the territory of the other: no more than 90 days within any 180-day period. For foreign nationals entering China under the visa-free policy, this means that, the total number of days a foreign national stays in China must not exceed 90 within 180 days prior to any date. The 90-day period does not include the days spent in China under visa, residence permit and other visa documents or APEC Business Travel Card. The visa-free entry will not be granted to any foreigner whose cumulative duration of visa-free stay has reached 90 days within a 180-day period. In the case where a foreigner's cumulative duration of stay has not reached 90 days while the remaining period is less than 30 days, the visa-free stay period for the foreigner concerned for this entry shall not exceed the remaining visa-free stay period. Chinese citizens going to Malaysia would follow the same practice.

We are confident that this agreement will further promote people-to-people exchanges, enhance mutual understanding and deepen multi-sector cooperation between both countries and people upon taking effect. It will mark a new step forward in advancing the high-level strategic China-Malaysia Community with a Shared Future. The Embassy of the People’s Republic of China in Malaysia will be working as dedicated as before to support and promote the friendly exchanges between peoples of both countries.
